Take for example the Superman case where the judge ruled on summary judgment in favor of the estates, and then Warner appealed. Not to say that ruling has been overturned.
With large corporations in control of these characters it's almost a certainty that any ruling against them will go up the ladder possibly all the way to the SCOTUS.  In that eventuality prospects for a large corporation emerging the victor are very high with justices like Roberts, Alito, Thomas, and Scalia, all having a very strong pro big business record.
