More accurately, the Court found the testimony of Sterank, Sinnot, Ayers, Lieber, and Romita to be consistent such that there were not disputes as to any material facts.  The Court basically accepted the Kirby's side's version of the facts, with the exception of any testimony by Evanier or the other "expert" (such as that Kirby had created certain characters before getting an assignment from Stan) because they were not percipient witnesses.
