This is what has me a bit conflicted.  I'm a strong advocate of first amendment rights, but at the same time am grieved to hear that the Buscema family is upset.  The thing to say is, of course if the publisher didn't violate anyone's rights in publishing the book, then they have the right to publish it, but at the same time, it wouldn't have hurt if they had consulted the family.  Does the book contain controversial or personal information?
