my sense is that the copyright claim gambit was merely the first step toward the current path forward--a suit against Marvel to prompt some form of profit sharing, etc based on the work Kirby did for them in the sixties.

some seem to be suggesting that the gambit may have actually been an attempt to claim the copyrights to these characters toward...making their own X-Men comics?

wasn't that the whole thing with the Siegel Superman lawsuit, or the "Steamboat Willie is public domain" issues--that sure, in theory, you CAN maybe make a Mickey Mouse cartoon based on that cartoon, but good luck getting it past Disney's lawyers, due to subsequent work and copyrights and (unless I'm mistaken) trademarks?
