I think that is why Marvel the corporate entity was always so opposed to any action that might have given Kirby the slightest legal opening to press claim to any of the characters.

I hold Jack (and Roz) in the highest esteem, but I have to wonder if this lawsuit would have taken wing if Disney's money had not entered into the picture. One thing is for sure, Disney is the master of copyright law and I would have to lay odds on them winning this dispute.
