Wolverine?

From the article:

One surprise in the lawsuit is an unexpected claim under the Lanham Act. The lawsuit targets two films, "The Incredible Hulk" released in 2008 and "X-Men Origins: Wolverine" released last year, as films that it claims were misrepresented in commercial advertising and promotion. The estate claims that Kirby was not properly identified as being the author or co-author of these works. The estate is seeking "up to three times the damages they sustained and will sustain," which isn't specifically identified, but could be significant. "Wolverine" made almost $375 million in worldwide gross.

I raised my eyebrows at that as well. But upon pondering it a moment, I think that it must pertain to the film Wolverine, in particular the other characters Jack had a hand in creating. Professor X and Blob, for instance. I don't know what the film said as far as a "Based on characters created by..." type of thing, but that list could get long. The Wolvie film could conceivably have a credit along these lines:

Based on characters created by Len Wein, Herb Trimpe, John Romita Sr, Chris Claremont, Jim Lee, Stan Lee, and Jack Kirby. Plus probably a couple/few more creators.

Where does the line get drawn as far as crediting creators if a film includes some minor characters created by myriad writers/artists?
