A gross oversimplification and factually inaccurate. The lawsuit was filed in 1941.

Whether DC "sued the pants off" Fawcett is highly debatable as the case dragged on for many years - during which time Fawcett continued cranking out Captain Marvel Adventures, Whiz Comics, Captain Marvel Jr., Master Comics, Mary Marvel, Wow Comics, The Marvel Family, Hoppy the Marvel Bunny, and Fawcett's Funny Animals - all of which featured some permutation of the basic Captain Marvel concept. And nearly all of those Marvel strips were launched AFTER DC sued Fawcett.

Fawcett was finally found guilty in 1952, but appealed that decision and then settled out of court because the comic book market was in a real slump and Fawcett had decided to cease publishing comics anyway. They published Captain Marvel from 1940 to 1953 - with the lawsuit chugging along in the background through the majority of that time period.

It seems the decision to cease publishing comics was a general business decision as Fawcett had other, non-Marvel related titles which they also cancelled. They simply wanted out of the comics business at that time. So they settled the lawsuit.
